Tire Recalls

Many tire tread separations subjects to recalls by NHTSA are often the result of bad tire design and manufacturing defects for which manufacturers are be held liable under the law. All product manufacturers have the legal responsibility to notify consumers of dangerous defects with their products and undertake recalls. In some cases, tire manufacturers fail to initiate a nationwide tire recall until after mounting injury lawsuits are filed by injured drivers and passengers. The auto manufacturer may also be liable for supplying the undersized or defective tires or spare tires as standard equipment with new vehicles.

Negligent Tire Shops

Many tire shops and used tire dealers sell aged tires that are too old to be safely used on the highway. Many of these used tires have been recalled, some with little tread life and others have been involved in previous wrecks and even rollover accidents. Many of these used tires have suffered internal damage from curb strikes, potholes, driven under-inflated or they have too many tire patches or plugs. If the tire shop owner or tire worker fails to advise or warn you of the bad tires and the need for new ones, then they may be held liable or negligent in an injury occurs. Additionally some tire shops fail to property inflate the tires to the correct air pressure or they place the best tires up front instead in the rear.
