On behalf of themselves and all others similarly situated, plaintiffs Christy Fargo, Bryan Abbee, and Tequon Brady filed a case against defendants Jacques Bermon Webster II (a/k/a Travis Scott); Harris County Sports & Convention Corporation (a/k/a NRG Stadium); NRG Energy, Inc.; Vivid Seats, LLC; SeatGeek, Inc.; Front Gate Ticket Solutions, LLC; StubHub, Inc.; ScoreMore Holdings, LLC; Live Nation Entertainment, Inc.; Live Nation Worldwide, Inc.; Live Nation Marketing.
Jurisdiction and Venue
The petition reads: “This is an action for unfair business practices under Texas Business and Commercial Code§ 17.46 et sec. and for breach of contract. This action seeks to recover a refund of the amount of the face value, processing costs and fees, and any other extraneous costs associated with the uses of the tickets to the 2021 Astroworld Festival for all persons who purchased a ticket to the concert as well as other expenses incurred in connection attending the concert event, and other remedies.
“. . . The claims asserted by Plaintiffs against Defendants are based on violations of state laws and Defendants’ duties, obligations, and responsibilities under state law.”
On November 5, 2021, when headliner Travis Scott began his set, a crowd surge resulted in mass panic when hundreds of concertgoers were being crushed against each other, unable to move or access adequate help. Eight (8) people were killed, including minors, and many others were seriously injured. A ninth person died the following week after being injured at the concert.
“The environment was filled with panic, confusion, and chaos. People were unable to exit the concert premises quickly and safely because there were not enough exits provided,” read the petition. “(The) premises also lacked sufficient medically trained staff and trained security personnel.”
Request for a Jury Trial
Plaintiffs are suing primarily to recover financial damages lost when the concert was canceled.
The petition proposes that all class members include: “All persons or entities in the United States who paid money to buy a ticket(s) and attended the 2021 Astroworld Concert in Houston, Texas scheduled to occur on November 5, 2021 and November 6, 2021 who have not received a refund from Defendants for the face value, processing costs and fees, and any other extraneous costs associated with the purchase and/or use of the tickets that they bought.”
Plaintiffs requested a jury trial. They are represented by attorney David P. Matthews of Houston.
