A judge overseeing the 3M Earplug cases has ordered that anyone with a case in the litigation must secure his or her own records now.
Failure to secure your records immediately will likely mean your case will not be allowed to go forward.
The 3M earplug litigation consolidated to an MDL in 2019 includes more than 280,000 US Military Men and Women. These service members and others claim in the lawsuit that their hearing was damaged from using 3M CAEv2 earplugs. The lawsuits all allege that the ear plugs were defective.
Bellwether Trials Favor Plaintiffs
To date, 17 of the initial 20 bellwether claims have gone to trial. Eight verdicts have been in favor of 11 plaintiffs, while six verdicts have gone for 3M. The judge overseeing the MDL has ordered 1000 more cases to be prepared to go to trial toward the end of this year. The judge will randomly select 500 more for trial this year.

3M Clients must Obtain Their Own Military Records
Judge Rodgers has ordered all claimants to obtain their own “Blue Button” military and medical records via https://www.myhealth.va.gov/mhv-portal-web/user-login
URGENT: Our clients must obtain their own Military and Medical records now, especially their DD 214 paperwork.
If you are a 3M earplug client of ours, we must have your military and medical records in order to proceed with your 3M case.
Please note: Because more than 280,000 claimants have inundated the VA and DOD, those government agencies are unable to process requests fast enough to support the litigation.
Judge Rodgers, who served in the military, believes strongly that all those wishing to continue with their 3M earplug case have the ability to go online and obtain their own military records. The judge has henceforth ordered that those plaintiffs must do so.
