Johnson & Johnson knew Talc-Ovarian Cancer Risk

Timely Insights on Laws, Issues and New Developements
|

JJ TALCLawyers for the Missouri plaintiffs who won a $72 million verdict last month against Johnson & Johnson brought up evidence which proved J&J knew of the Talc-Ovarian Cancer Risk, yet failed to warn customers. Millions of women who used J&J’s Baby Powder and Shower-to-Shower products on themselves and their babies were hence never made aware of the cancer link. Johnson & Johnson now faces more than 1,200 Talcum Powder Cancer Lawsuits from women who say their ovarian cancer was caused by long-term use of talc. A thousand cases have been filed in Missouri, some 200 in New Jersey.

Johnson’s Baby Powder and Shower to Shower

Johnson’s baby powder contains 99% talc, while its Shower to Shower contains 50% talc and 50% corn (presumably GMO) starch. J&J has now lost two trials after talc fibers were found in the cancerous ovaries of women who had used J&J talc for extended periods of time. In the first talc-ovarian cancer trial, a South Dakota jury also found for the plaintiff.

Talc Ovarian Cancer Trial Updates

Four more jury trials for talc-ovarian cancer cases are planned for 2016 in Missouri and New Jersey state courts. We will keep you up to date on the latest developments.

What Johnson knew and when

Documents produced into evidence in the latest talc trial in Missouri showed Johnson & Johnson was put on notice way back in 1975 that portions of talc were found in the cancerous ovaries of women. The talc is believed to transmigrate to the ovaries up through the fallopian tubes.

Targeted Blacks, Hispanics

Court documents also showed that Johnson & Johnson targeted Black and Hispanic women, after learning women in those groups were heavy users of the company’s two flagship products.

Johnson & Johnson knew Talc-Ovarian Cancer Risk

Twenty-three (23) medical journal articles now show an increased risk of ovarian cancer for women who are long-term users of talc products for feminine hygiene. Back in 1994, nine studies had already shown a significant association between talc used for feminine hygiene and ovarian cancer. Long-term exposure to talc has now been associated with a 200-500% increased risk of ovarian cancer.

Talc Cases abound

  • 10% of all ovarian cancer cases are believed to be talc related.
  • 25,000 ovarian cancer cases diagnosed per year.
  • 15,000 deaths from ovarian cancer per year.

Do I have a Talc Ovarian Cancer case?

At least four criteria apply to make a viable talc-ovarian cancer case:

  1. Long-term use of talc >four (4 ) years.
  2. Ovarian cancer diagnosis before 65 years of age.
  3. BRCA negative status (though most women probably haven’t tested)
  4. Diagnosis of ovarian cancer (specifically)
